TERMS OF USE FOR agreEAT

1. ABOUT agreEAT
agreEAT is an app that helps families, couples, friends and other small groups agree on what to eat by voting on dishes.
agreEAT is provided by Andreas Svahn, a sole trader operating under the name Labud Labs.
These Terms of Use ("Terms") apply when you use agreEAT.
By using agreEAT, you accept these Terms. If you do not accept the Terms, you should not use the service.
2. THE SERVICE
agreEAT provides features that may include:
- creating and joining groups,
- inviting others to groups,
- selecting which participants will take part in a round,
- voting on dishes,
- conducting finals and random decisions,
- adding custom dishes and images,
- managing a shared food library,
- receiving push notifications when the feature is available and enabled,
- using other features that are available in the app from time to time.
The features of the service may change over time. Features may be added, changed or removed.
3. USERS AND TECHNICAL IDENTITY
agreEAT is designed to be used without traditional account registration. You therefore normally do not need to create an account using an email address and password.
Instead, a technical, anonymous user identity may be created so that the service can recognise you and associate you with, for example, groups and rounds.
You are responsible for the device and installation of the app that you use.
If the app is uninstalled, the app's local data is deleted, or you change devices, you may lose access to previous groups or other information if no recovery feature is available.
You should therefore not regard agreEAT as a service for permanent storage of information.
4. GROUPS
Users can create groups and invite other users.
The person who creates a group will normally become the group owner. The group owner may have special permissions, for example to manage members, certain dishes and the group as a whole.
Ownership may in some cases be transferred to another group member.
A group code or invitation link may allow other people to join the group. You are responsible for sharing such invitations only with people whom you want to give access to the group.
We are not responsible if a group code or invitation link is shared by a user with another person.
5. VOTING AND RESULTS
agreEAT is a tool for making shared everyday decisions about food.
Results may depend on participants' votes and, in some situations, random decisions.
When several dishes have the same result, agreEAT may, for example, use a final or a wheel of chance to determine which dish wins.
A random decision means exactly that: the result is random. No participant is entitled to a particular result.
A result in agreEAT is only a suggestion or shared decision within the app. agreEAT does not order food and does not guarantee that the winning dish can be cooked, purchased or ordered.
6. FOOD, ALLERGIES AND HEALTH
agreEAT does not provide medical advice, dietary advice or individual advice regarding allergies, intolerances or other health conditions.
Names, images, categories or other information about dishes must not be regarded as a guarantee of a dish's ingredients, nutritional content or suitability for a particular person.
You are responsible for checking ingredients, allergens and other relevant information before food is prepared, purchased or eaten.
If you or anyone else has allergies, intolerances or specific medical or dietary needs, these must always be checked separately.
7. CUSTOM DISHES AND OTHER CONTENT
Users may add custom dishes and, in some cases, images or other content.
You are responsible for the content that you add.
You must not add content that:
- you do not have the right to use,
- infringes another person's copyright, trademark or other rights,
- is unlawful,
- is threatening, abusive or discriminatory,
- contains malicious code or other material that may harm the service or other users,
- contains personal data or other material for which there is no lawful basis or permission to publish.
When you upload content to agreEAT, you grant us a non-exclusive right to store, process, copy and display that content to the extent necessary to provide the service.
You otherwise retain the rights that you have to your own content.
We may remove content that violates these Terms or that we need to remove for security, legal or technical reasons.
8. IMAGES AND INTELLECTUAL PROPERTY RIGHTS
You may only upload images that you own or otherwise have the right to use in the manner required for agreEAT.
The fact that an image is available on the internet does not automatically mean that it may be used.
agreEAT, its name, design, software code, graphics, texts and other material belonging to the service are protected by applicable intellectual property laws.
These Terms give you the right to use the service for its intended purpose but do not transfer any intellectual property rights to you.
9. PERMITTED USE
You may use agreEAT for its intended purposes and in accordance with these Terms and applicable law.
You must not attempt to:
- gain unauthorised access to other users' or groups' information,
- circumvent the service's permission or security features,
- manipulate votes, results, purchases, ad-free status or other features,
- disrupt or overload the service,
- use automated methods in a manner that harms or abuses the service,
- use agreEAT for unlawful purposes.
We may restrict or stop access to the service if it is used in a way that violates these Terms, creates security risks or may harm the service or other users.
10. ADVERTISING
The free version of agreEAT may contain advertisements.
Advertisements may be provided by external advertising providers.
The display of an advertisement in agreEAT does not mean that we recommend, guarantee or accept responsibility for the advertised product, service or the advertiser's activities.

11. AD-FREE ACCESS AND IN-APP PURCHASES
agreEAT may offer a purchase that removes advertisements or provides other expressly stated benefits.
Purchases in the mobile app are made through the store from which the app is distributed, such as the Apple App Store or Google Play.
The price, currency, payment terms and any applicable taxes are displayed by the relevant store before purchase.
Purchases are also subject to the terms of the relevant store provider.
Where supported, a previous purchase may be restored through the store and account used for the original purchase.
Purchasing ad-free access does not affect how votes or results are calculated.
Unless otherwise expressly stated at the time of purchase, ad-free access means that the advertisements in agreEAT covered by the offer are removed. It does not mean that the user purchases the app itself, its content or any intellectual property rights.
12. RIGHT OF WITHDRAWAL, REFUNDS AND CONSUMER RIGHTS
For purchases made through the Apple App Store or Google Play, payment is handled by the respective store provider.
Requests for refunds may therefore need to be made through the store where the purchase was made.
Nothing in these Terms limits any rights you have under mandatory consumer protection law.
13. PUSH NOTIFICATIONS
agreEAT may send push notifications about, for example, a new round or other relevant events.
Delivery of push notifications may depend on your device, operating system and external service providers. We therefore cannot guarantee that a particular notification will always be delivered or will be delivered at a particular time.
You are not required to keep notifications enabled and may disable them through your device settings.
Important information should therefore not depend on the delivery of a push notification.
14. AVAILABILITY AND CHANGES
We aim to keep agreEAT stable and available but cannot guarantee uninterrupted or error-free operation.
The service may temporarily be unavailable due to, for example:
- maintenance,
- technical problems,
- network problems,
- failures of external service providers,
- updates,
- circumstances beyond our control.
We may change, develop, replace or remove features when necessary.
We may also discontinue all or part of the service.
15. EXTERNAL SERVICES
agreEAT may depend on external services, for example for operation, storage, push notifications, advertising, payments and distribution of the app.
Such services may have their own terms and privacy policies.
We are not responsible for the operation of external services except to the extent required by mandatory law.
16. LIMITATION OF LIABILITY
agreEAT is provided as a tool for making everyday decisions about food.
We are not responsible for decisions users make as a result of an outcome in the app, such as what food is prepared, purchased or ordered.
We are not responsible for content added by users or for whether such content is accurate, lawful or appropriate.
To the extent permitted by law, we are not liable for indirect damages or losses arising from the use of the service or temporary interruptions.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.
17. DELETION, LEAVING GROUPS AND STOPPING USE
You may stop using agreEAT at any time.
The app may contain features for leaving groups, deleting your own dishes and, for group owners, deleting groups.
Because agreEAT can be used without a traditional account, uninstalling the app or deleting local data may cause you to lose the ability to access previous groups.
Uninstalling the app does not necessarily mean that all information stored on the server is automatically deleted.

The Privacy Policy is separate from these Terms and describes, among other things, what information may be processed, why it is processed and what rights you may have.
19. CHILDREN
agreEAT is intended for adult users but may be used by families where children participate together with adults.
If a child uses agreEAT, the child's parent, guardian or other responsible adult is responsible for ensuring that the use is appropriate and complies with applicable rules.
The service must not be used by children in a manner that requires consent or another lawful basis that is not available.
20. CHANGES TO THESE TERMS
We may update these Terms as the service develops or when necessary for legal, security or technical reasons.
The date at the top indicates when the Terms were last updated.
In the event of material changes, information may be provided in the app or by other appropriate means.
If a change requires renewed acceptance under applicable law, this will be handled in an appropriate manner.
21. GOVERNING LAW AND DISPUTES
These Terms shall be interpreted in accordance with Swedish law, without limiting any mandatory consumer protection rights to which you are entitled under the law of the country in which you live.
If a dispute arises, we ask that you first contact us so that we can try to resolve the matter.
Consumers in Sweden may also be entitled to refer a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN).
Disputes may also be heard by a court of competent jurisdiction.
